This License Agreement is a legal agreement between you (either an individual or a single entity) and Descriptor Systems for a Descriptor Systems ShareWare CourseWare Workshop (the WORKSHOP).
By installing, copying, or otherwise using the WORKSHOP, you agree to be bound by the terms of this License Agreement. If you do not agree to the terms of this License Agreement, do not install or use the WORKSHOP, and promptly return the entire unused WORKSHOP to your place of purchase for a full WORKSHOP.
The WORKSHOP distributed in the form of a ShareWare CourseWare™ download is for your private, personal and non-commercial use only. Any other use, including using the WORKSHOP to train for a fee is strictly prohibited. If you wish to use the WORKSHOP in any other way, you must purchase a commercial license as described on this page.
The WORKSHOP is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The WORKSHOP is licensed, not sold.
To the extent that you have elected to purchase the WORKSHOP, Descriptor Systems grants to you as an individual a personal, nonexclusive license to make and use copies of the WORKSHOP in the manner provided below. If you are an entity, Descriptor Systems grants to you the right to designate one individual within your organization to have the right to use the WORKSHOP in the manner provided below.
You can make copies of the WORKSHOP as you see fit. You may distribute the copies as you wish, with the exception that you may not charge a fee to redistribute the WORKSHOP.
THE WORKSHOP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DESCRIPTOR SYSTEMS AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY AGAINST INFRINGEMENT, WITH REGARD TO THE WORKSHOP. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION.
DESCRIPTOR SYSTEMS'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL NOT EXCEED THE PRICE PAID FOR THE WORKSHOP.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DESCRIPTOR SYSTEMS OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS DESCRIPTOR SYSTEMS PRODUCT, EVEN IF DESCRIPTOR SYSTEMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
